UNAIR NEWS – Health Law Study Center of FH UNAIR held a focus group discussion (FGD) on Hospital Pharmacy Services on Wednesday, June 29, 2022. The event, which was conducted hybrid in Faculty Club, Building A of FH UNAIR via Zoom meeting, featured the FH lecturer Prillian Cahyani SH SAP MH LLM.
Prillian explained that currently, no legislation specifically addresses the legal aspects of medication errors in pharmaceutical services. The medication error was found in the pharmaceutical service standards but was not issued in the law.
“One of the pharmaceutical services is providing drug with doctor’s prescriptions. It must be based on pharmaceutical service standards, which turns out, has potential for medication error,” he said.
Yet to have juridical definition
Prillian stated that medication error is yet to have a juridical definition within the law. It may cause problems related to the legal definition of medical errors and who will be responsible if it occurs.
“The arising legal problems will be the one who is legally responsible for the medication error, considering the long journey of pharmaceutical service.”
Furthermore, he claimed that there are no clear regulations regarding the responsibility of medical and health workers on error medications that are at high-risk from the legal perspective. In fact, according to him, the purpose of the law must have certainty and benefit that must be achieved.
Minimum legal protection
“If this has not been regulated in detail, it is hard to provide an optimal legal protection for medical and health workers,” he said.
Nowadays, electronic prescription is also well-known. He said that electronic prescriptions may raise ethical issues and legal problems associated with data leakage due to their accessibility.
“Electronic prescription is set through a digital system. Health services were directed to electronic service, especially during the pandemic,” he said.
