UNAIR NEWS – The Constitutional Court (MK) session on 2024 election dispute has gained public attention for the last few weeks. The verdict is officially read out on Monday, April 22, 2024. It holds profound significance for the society.
A lecturer of UNAIR FISIP Political Science, Ali Sahab SIP Msi puts forward his critical view related to the 2024 election dispute verdict. The view should be a reflection for society in fortifying Indonesian democracy.
According to Ali, MK has demonstrated noteworthy progress compared to preceding periods. “This MK period has shown advancement compared to its predecessors, where the decisions were primarily focused on vote tallies,” he stated.
Furthermore, Ali asserted that MK has accommodated more qualitatively substantial demands from the petitioners, presidential candidate number 01 and 03. “MK is expected to reinforce the pillar of democracy,” he added.
On the contrary, the MK’s verdict has attracted mix reactions from the involved parties. “The MK’s verdict this time indeed brings satisfaction to one party and undoubtedly disappoints the petitioners whose demands were not granted,” stated Ali.
Nevertheless, Ali assessed that the dissenting opinions voiced by three judges signify progress in democratic governance. “We cannot ascertain whether there’s political pressure on the MK. What’s paramount is the role played by the MK in upholding democracy,” he expressed.
He considered that with the MK’s verdict, the election dispute could be deemed concluded. However, Ali Sahab also emphasized the importance of the administration embracing political competition.
“If they choose not to join the government, it is their prerogative, as opposition also ensures democracy stays on its course,” he clarified.
Furthermore, regarding the limited time for the prosecution’s evidence, Ali evaluated that the MK indeed faces constraints. “With such scant evidence presentation time, it’s implausible to substantiate claims, hence the MK cannot be relied upon as a major hope for adjudicating election disputes, especially those about substantial demands,” he asserted.
In response to the released verdict of the 2024 election dispute trial, Ali conveyed a message to the Indonesian populace. “My suggestion is: Be discerning voters so there won’t be a necessity for election dispute claims. If the populace discerns what is best, refrains from undermining democracy, and can contribute to public welfare, it will yield good voters as well. If our voters are still rooted in maximizing material benefits, then a fair and free election, akin to those in countries with advanced democracies, remains distant,” he explained.
