Omah Rembug Adhyaksa FH UNAIR: Observing the Practice of Resolving Cases with Restorative Justice

Restorative Justice is commonly known as a method of law enforcement that emphasizes elements of recovery. The main goal of Restorative Justice is to solve problems by agreement. Regarding this matter, the Faculty of Law, Airlangga University, on July 30, 2022, after going through a long process and collaborating with the Surabaya District Attorney, has provided a place and facilities for Restorative Justice.

On Thursday (30/3/2023), Omah Rembug Adhyaksa FH UNAIR or the House of Restorative Justice FH Unair facilitated conflict resolution. One of the conflicts resolved by Rembug Adhyaksa’s house was the gold theft committed by a suspect named Rahman. Rahman was accompanied by his relatives and also Rahman’s father, while the victim, Ms. Yayuk, was accompanied by her husband, sister, and husband in resolving this conflict. The Facilitating Prosecutor who mediated for the two parties was Mr. Neldy Denny S.H. In the process, the Facilitating Prosecutor allows both parties to convey the theft incident first. The explanation begins with how Rahman entered and stole Bu Yayuk’s gold. Then it was continued by the explanation of Mrs. Yayuk’s sister as a witness.

Conflict resolution between Rahman and Bu Yayuk by Facilitating Prosecutor Neldy Denny S.H. After clarifying everything, the Facilitating Prosecutor asked the victims and their families to demand their rights by making clause points that the suspects had to fulfill. Apart from the six clauses previously proposed, Mrs. Yayuk made three new conditions that Rahman and his family had to meet: “Gold is received in full, there is no revenge, and the suspect returns material rights that have been wasted,” concluded Mrs. Yayuk. Mrs. Yayuk had to say this. After all, Rahman had often entered Mrs. Yayuk’s house without permission because Rahman lived in a boarding house next to Mrs. Yayuk’s house.

After all, the clauses were stated, and the willingness of Rahman and his family had been stated, Mr. Neldy ended the conflict resolution. Mr. Neldy also said, “Losses can be borne depending on the ability of the family,”. This reflects the difference between Restorative Justice and other conflict resolutions. This was one of the three conflicts the Attorney General’s Office resolved that day at the Faculty of Law, Universitas Airlangga.
